1. OVERVIEW

Landscapes.App ("the App") is a photo sharing application. The app is an ad-free, subscription-based social media platform that provides access to all core features including photo sharing, following, liking, notifications, and moderation tools. By using the App, you agree to these Terms and Conditions.

1A. Eligibility
Users must be at least 16 years old to create an account and use the App. By using the App, you confirm that you meet this age requirement and have the legal capacity to enter into these Terms.

2. ACCOUNT CREATION AND PRIVACY CONTROLS

- Users can create accounts that are either Public or Private.

- Public accounts allow any user to follow and view posts.

- Private accounts require follow requests to be approved, denied, or blocked by the account owner.

- Users receive notifications for new follow requests and the outcome of their requests.

- Users may block other users at any time, preventing interaction and visibility.

3. PHOTO FEEDS

- Photos are displayed in two main feeds:

a. Discover Feed: A public feed displaying photos only from public accounts.

b. Following Feed: Displays photos only from users you follow.

- If your account is private, your photos will NOT appear in the Discover (public) feed.

- Content in all feeds is displayed strictly in chronological order by posting time.

- The App does not use algorithmic ranking or personalization for content display

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

4. LIKES AND NOTIFICATIONS

- Users can 'Like' photos; there is no comments section.

- Users receive notifications when others like their photos.

- Notifications are also sent regarding new follow requests and responses.

5. USER INTERACTION CONTROLS

- Users can block other users at any time, which removes the blocked user’s access to their content and interactions.

- Users can flag posts they believe violate the App’s policies.

6. NOTIFICATIONS

- The App may send in-app or push notifications related to likes, follow requests, and follow request outcomes.

- Users may control notification preferences through app or device settings.

7. CONTENT MODERATION AND SAFETY

- Landscapes.App uses a hybrid moderation system combining automated screening and human review.

- All newly uploaded photos and captions are automatically screened for:

  • Hate speech or violent content
  • Sexual exploitation, pornography, or nudity
  • Harassment, threats, or abuse
  • Content endangering individual or group safety
  • Violation of laws or regulations

- Violating content may be hidden, flagged, removed, or lead to account restrictions.

- Users may flag posts by selecting reasons such as hate speech, violence, sexual content, harassment, misinformation, or other.

- When a post is flagged:

  • It is hidden from the flagging user’s feed.
  • Other users see the post blurred with a warning message:
    • “⚠️ This post has been flagged by another user for potentially including content that is racist, hateful, pornographic, or endangers the safety of others.”
  • • Users may choose to “View Anyway” at their discretion.

- When a post is flagged, it is sent to the Landscapes.App Admin for review.

  • If the Admin determines the post violates the App’s content policies, they may permanently delete the post.
  • If the Admin determines the post does not violate policies, they may restore the post to be visible again.
  • The post creator will be notified if their post is flagged, deleted, or restored.

- The Admin also has the authority to suspend a user’s account for a limited or indefinite period for violations. Suspended users will be notified accordingly.

- Misuse of the flagging system may result in loss of reporting privileges or account suspension.

7. CONTRIBUTION LICENSE

By posting your Contributions to any part of the Site, you automatically grant, and you represent and warrant that you have the right to grant, to us an unrestricted, unlimited, irrevocable, perpetual, non-exclusive, transferable, royalty-free, fully-paid, worldwide right, and license to host, use, copy, reproduce, disclose, sell, resell, publish, broadcast, retitle, archive, store, cache, publicly perform, publicly display, reformat, translate, transmit, excerpt (in whole or in part), and distribute such Contributions (including, without limitation, your image and voice) for any purpose, commercial, advertising, or otherwise, and to prepare derivative works of, or incorporate into other works, such Contributions, and grant and authorize sublicenses of the foregoing. The use and distribution may occur in any media formats and through any media channels.

This license will apply to any form, media, or technology now known or hereafter developed, and includes our use of your name, company name, and franchise name, as applicable, and any of the trademarks, service marks, trade names, logos, and personal and commercial images you provide. You waive all moral rights in your Contributions, and you warrant that moral rights have not otherwise been asserted in your Contributions.

We do not assert any ownership over your Contributions. You retain full ownership of all of your Contributions and any intellectual property rights or other proprietary rights associated with your Contributions. We are not liable for any statements or representations in your Contributions provided by you in any area on the Site. You are solely responsible for your Contributions to the Site and you expressly agree to exonerate us from any and all responsibility and to refrain from any legal action against us regarding your Contributions.

We have the right, in our sole and absolute discretion,
(1) to edit, redact, or otherwise change any Contributions;
(2) to re-categorize any Contributions to place them in more appropriate locations on the Site;
(3) to pre-screen or delete any Contributions at any time and for any reason, without notice. We have no obligation to monitor your Contributions.

8. SUBSCRIPTION AND PAYMENTS

- The App requires a monthly subscription.

- Payment is processed via Apple App Store or Google Play Store accounts.

- Subscriptions auto-renew monthly unless canceled at least 24 hours before the renewal period.

- Users can manage or cancel subscriptions via their device's app store settings.

- No refunds are provided for partial billing periods.

- Any pricing changes will be communicated in advance; continued use constitutes acceptance.

9. ADVERTISING AND MONETIZATION

- Landscapes.App does NOT display any paid advertising.

- The platform is supported solely by subscription fees.

- User data is not sold to advertisers; no third-party ads or sponsored content are shown.

10. CONTENT FEED PRESENTATION

- Content is displayed strictly in chronological order.

- No algorithmic personalization or ranking is used.

11. SHARING POSTS

- Posts cannot be reshared or reposted within the app.

- Off-platform sharing is allowed via device native features (SMS, email, social media).

- If your account is public, other users may share your posts off-platform.

- If your account is private, only you may share your posts; others cannot share your private posts.

11A. License to Use User Content

Byuploading photos or other content to the App, you grant Landscapes.App a non-exclusive, worldwide, royalty-free license to use, display, and distribute such content within the App solely for the purpose of operating and improving the service.

12. USER CONDUCT

- Users agree not to upload content or engage in behavior that violates laws, infringes rights, or disrupts the App’s operation.

- Landscapes.App reserves the right to suspend or terminate accounts for violations.

12A. Termination

Landscapes.App reserves the right to suspend or terminate any user account at any time, with or without notice, for violating these Terms or for any other reason at our sole discretion.

12B. Intellectual Property

All content and materials on the App, including but not limited to logos, trademarks, code, and design elements, are the property of Landscapes.App or its licensors and are protected by intellectual property laws. Users may not copy, reproduce, or distribute any part of the App without prior written permission.

12C. Third-Party Services

12C. Third-Party Services The App may integrate with or make use of third-party services. Landscapes.App is not responsible for the content, functionality, or privacy practices of these third-party services. Use of such services is subject to their own terms and policies.

12D. Data Retention

User data may be retained for a reasonable period after account deletion to comply with legal obligations, resolve disputes, and enforce our agreements. After such time, data will be securely deleted or anonymized.

The App is provided “as is.” We disclaim warranties and are not liable for damages arising from use.

13A. Dispute Resolution and Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law principles. You agree that any disputes arising under or in connection with these Terms will be resolved through binding arbitration or in small claims court, as appropriate, in California.

13B. Changes to the App

Landscapes.App may modify, update, or discontinue any part of the App at any time without prior notice. Continued use of the App after such changes constitutes your acceptance of the modified App.

13C. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, either express or implied, including, but not limited to, warranties of merchantability, fitness for a particular purpose, or non-infringement. Landscapes.App does not warrant that the App will be uninterrupted, secure, or error-free.

13D. Indemnification

You agree to indemnify, defend, and hold harmless Landscapes.App, its affiliates, officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses, including reasonable legal fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your infringement of any third-party rights.

13E. Accessibility and International Use

Landscapes.App is intended for users in jurisdictions where the App and its Terms comply with applicable laws. You are responsible for ensuring that your use of the App is legal in your location and that you comply with all local laws and regulations.

14. CHANGES TO TERMS

- We may update these Terms from time to time. Changes will be posted in the App.

- Continued use after changes constitutes acceptance.>

If we terminate or suspend your account for any reason, you are prohibited from registering and creating a new account under your name, a fake or borrowed name, or the name of any third party, even if you may be acting on behalf of the third party. In addition to terminating or suspending your account, we reserve the right to take appropriate legal action, including without limitation pursuing civil, criminal, and injunctive redress.
