1. ELIGIBILITY
You must be at least 16 years old to use the Service.
2. DESCRIPTION OF THE SERVICE
Landscapes.app is a subscription-based photography-focused community that may include profiles, profile website links, photo sharing, following, location tagging, discovery features, notifications, invitations, referrals, and other features introduced from time to time.
3. FREE TRIAL
Eligible users may receive a free trial. Unless cancelled before expiration, the selected subscription converts to a paid subscription.
4. SUBSCRIPTION PLANS
View Only, Starter, and Unlimited plans may be offered. Features, limitations, pricing, and availability may change.
Starter accounts may be subject to posting limits. When limits are reached, the oldest posts may be removed on a first-in, first-out basis.
5. BILLING, RENEWAL & CANCELLATION
Subscriptions automatically renew unless cancelled through the applicable marketplace.
6. UPGRADES & DOWNGRADES
Users may upgrade or downgrade plans subject to marketplace billing rules.
7. ACCOUNT DELETION
Users may delete their accounts. Access may continue through the end of the current paid subscription period.
8. COMMUNICATIONS
Transactional communications may include verification, billing, security, support, and subscription notices.
Optional communications may include weekly digests, featured photographers, product updates, community announcements, and promotions.
9. USER CONTENT
Users retain ownership of uploaded content.
Users grant Landscapes a non-exclusive license necessary to host, display, distribute, and operate the Service.
Users represent that they own or possess all rights necessary to upload content.
10. PROFILE LINKS
Users may publish website URLs in profiles and are responsible for linked destinations.
Landscapes is not responsible for third-party websites.
11. LOCATION TAGS
Location tagging is optional. Users should exercise caution when sharing location information.
12. COMMUNITY GUIDELINES
No harassment, hate speech, explicit content, graphic violence, scams, spam, impersonation, intellectual property infringement, privacy violations, or unlawful activity.
13. MODERATION
Landscapes uses a hybrid moderation approach including automated systems, user reports, and human review.
Technologies may include Microsoft PhotoDNA and Azure AI Content Safety.
14. COMMUNITY STANDARDS & DISCRETIONARY ENFORCEMENT
Landscapes may remove content inconsistent with the purpose, spirit, safety, or intended use of the platform, even if not specifically prohibited elsewhere.
15. REFERRALS & PROMOTIONS
Referral programs, contests, rewards, and promotions may be modified or discontinued at any time.
16. AI CONTENT
Policies regarding AI-generated or synthetic content may evolve.
17. USERNAME AVAILABILITY
Usernames may be reclaimed, modified, or reassigned if inactive, infringing, misleading, or disruptive.
18. COPYRIGHT COMPLAINTS
Claims may be submitted to info@landscapes.app.
19. INTELLECTUAL PROPERTY
Except for user content, all Service intellectual property belongs to Landscapes or its licensors.
20. TERMINATION
Accounts may be suspended or terminated for violations of these Terms or applicable law.
21. DISCLAIMERS
The Service is provided AS IS and AS AVAILABLE.
22. LIMITATION OF LIABILITY
Liability is limited to the maximum extent permitted by law.
23. INDEMNIFICATION
Users agree to indemnify Landscapes for claims arising from their content or use of the Service.
24. GOVERNING LAW
These Terms are governed by the laws of Massachusetts and the United States.
